Social implications regarding the judicial treatment of violence on grounds of gender identity or sexual orientation

The scientific communication aims to develop conceptual approaches that account for access to justice and legal treatment of violence against people who make up sexual diversity. Therefore, it is proposed a review and analysis of the literature and statistical data produced by public institutions specialized in the subject with reference to the legislative context inherent to the Argentine State. Accordingly, although the work is not a case study, it states facts that have been passed on to judicial courts and the media which may be relevant for providing empirical references to support theoretical arguments. Accordingly, the essay is structured around the social worker’s role as expert witness in producing evidence for judicial debate and applying the perspective of sexual diversity in court cases investigating violence against women LGBTTTIQ+ people. In this line of ideas, to present a theoretical approach to the prism of social discrimination and legal asymmetry based on the heteronormative parameters that govern power spaces in interpersonal relations. Also, consider the vulnerability of victims of crime and the social context in which violence is reproduced on the basis of gender identity or sexual orientation.
