Abstract

The art. 60 of Royal Legislative Decree 8/2015, of October 30, which approves the consolidated text of the General Social Security Law after its modification carried out by RDL 3/2021 of February 2, regulates the new contributory pension complement to reduce the gender gap. The work analyzes the justification and necessity of the difference in treatment between women and men that occurs in its regulation and analyze whether it incurs direct or indirect discrimination based on sex.
