The means of defense of economic operators in the face of freedom of establishment and movement within the framework of the market unity guarantee law

Abstract

Law 20/2013 of December 9, Guarantee of the Market Unit for its
density and innovations is destined to have a major impact on our
legal system, both in the subjective order (access to economic activities
under market conditions and its exercise by operators legally
established anywhere in the national territory, according to article 2) as
in the properly territorial dimension of the Market Unit so that <
no authority may directly or indirectly obstruct> the free movement and
establishment of goods and services (art1.2). Although this last territorial dimension
will require, due to its complexity, a long period of institutional coupling and
administrative to implement the effectiveness throughout the national territory of the
administrative actions according to the place of origin and destination (art 19 and 20),
