THE NEED FOR THE ENACTMENT OF A NATIONAL UNIFYING REGULATION ON PORT LAW INSTITUTIONS IN THE ARGENTINE REPUBLIC

Abstract

This paper examines the need for the enactment of a national regulation to unify the various port law institutions in the Argentine Republic. Since the enactment of Law No. 24,093 on Port Activities, a process of normative dispersion has emerged among the country’s ports, resulting in heterogeneous legal frameworks that hinder coherence within the national port system. Considering that constitutional frameworks form the foundation of legal regimes in port matters, the study provides a brief overview of the Argentine constitutional system and the clauses that guide the distribution of powers in this field. It concludes that the establishment of a national unifying regulation is essential to restore legal harmony and ensure the efficient and coordinated functioning of Argentina’s port system.
