The extinction of credit linked to the financing of dental treatments. Regarding the Judgment of the Provincial Court of Madrid, of January 31, 2019

Abstract

The current paradigm of the Spanish dental panorama, the product of a historical evolution that sometimes described in the introduction, has turned patients / clients into dental consumers, who very often go to the financing of their contracts with dental clinics through of linked credits, from the clinical clinic itself with great frequency. Failure to comply with the agreed treatment, whether due to an incorrect, defective or non-existent realization thereof, causes the situation paradoxically in which the user is religiously paying a loan whose link to the treatment not received is an evident issue, and without obtaining the supply of goods and contracted dental services. In this work we address, under the pretext of minor jurisprudence, the extinction of the credit linked to a contract for the provision of dental care and the conditions that must be in place so that the patient / client / consumer can interrupt the payment of the credit linked to treatments dental, when said goods or services are provided defectively, or are completely breached.
